Regarding arbitration, our philosophy is:
1) Just as there is no letter that cannot be written on a single page, there is no arbitration that cannot be tried in one or two days. The secret is to impose upon each side a time limit for presenting evidence.
2) Given that arbitration is a poor substitute for a jury trial, arbitration at least should be expeditious, simple, and economical.
Regarding mediation, our philosophy is:
1) There is no case that cannot be resolved via mediation if everyone wants it to resolve it and exerts the right degree of effort -- even if it takes working 'til midnight.
2) The parties and the mediator must never part ways without first signing a written settlement and release that addresses everything, with absolutely no details left for later. With notebook computer in hand at every mediation, Mr. Bartley can very swiftly produce a custom-tailored settlement agreement and general release.
